US Senate passes new bankruptcy bill

In a vote of 74-25 last Thursday, the US Senate passed a measure that would change bankruptcy laws, making it harder for individuals seeking relief from their debt burden to avoid repayment. Almost twenty Democrats joined Republicans, who currently hold a majority of the seats in the US Senate, in passing the bill.

Lobbyists for credit card companies and financial services firms have worked for the bill during the last two administrations. A similar measure passed both the Senate and House during the previous administration, but then President Bill Clinton pocket-vetoed the measure in 2000.

Democrats sought to soften the bill by allowing bankruptcy filers to negotiate directly with lenders for relief, but the amendments were defeated by the Republican-controlled Senate. Proponents of the bill claim the rise of bankruptcy filings to nearly 1.5 million a year shows that abusers of credit use the filings to shield themselves from irresponsible practices.

“There has been an explosion of bankruptcy,” said Iowa Republican Sen. Charles E. Grassley, the bill’s sponsor. “We preserve the principle of a fresh start, but we also establish a principle that if you have the ability to repay some of your debt, you are not going to get off scot-free.” However, Massachusetts Democratic Sen., Edward M. Kennedy said, “This legislation makes the bankruptcy courts of the United States the collection agency for the credit-card industry.”

The bill impacts a broad spectrum of bankruptcy law, but the most significant impact is on personal bankruptcy filings. Individuals who get behind in repaying credit card debt face high interest charges and stiff late payment fees. By only meeting minimum payment requirements, borrowers remit to the lender over the life of the loan an amount in interest and other fees that can far exceed the value of the principal balance of the loan. This can put consumers who run up high balances on various cards at financial risk of default. Critics of the bill blame these aggressive lending practices as a contributing factor in the rising trend of bankruptcy filings from 1996.

The proposed bill doesn’t only affect debtors with credit card debt.

It also affects debtors who have run up large medical bills.

Patients with a past medical history that disqualifies them from full medical coverage, can easily find themselves facing insurmountable medical bills after just a short stay in the hospital. These individuals will no longer be able to get a fresh start after these personal disasters, and will be forced to live in poverty until they can pay off their medical bills as part of their Chapter 13 filing. (Prior to this bill, they would have been able to file Chapter 7, completely discharging their debt.)

Chapter 7, which accounts for 70% of bankruptcy filings, allows individuals to eliminate most non-secured debts after liquidating assets, with the notable exemption of one’s principle residence in most states. The Senate passed bill would change Chapter 7 eligibility by applying a means-test, where those with a median income higher than the state average would be required to file under Chapter 13 provisions. Under Chapter 13 protection, an individual’s debt is not forgiven; rather it is restructured for payment under more lenient terms.

This was the first major overhaul of federal bankruptcy law in many years.

Under the old bankruptcy law, a personal bankruptcy attorney could not be held financially responsible for his clients mendacity. Under the new bankruptcy law, the bankruptcy attorney is responsible for his client’s lies to the Court about his assets and the bankruptcy attorney and his insurance carrier can be held responsible by the Bankruptcy Court.

The result is that personal bankruptcy attorneys (this does not apply to corporate bankruptcy attorneys) are likely to flee the personal bankruptcy field when the new law takes effect. Their insurance companies will not offer the sort of coverage that they would need to continue to practice.

So when consumers need to file personal bankruptcy under the new law, they will be unlikely to find a bankruptcy attorney to represent them. Consumers will have to file pro se: such consumers will be likely to fail due to the complexity of the law.

The bottom line is that the field of personal bankruptcy law as a practice area of law will cease to exist when the new bankruptcy law takes effect, and consumers will be unable to secure legal counsel and so consumers will lose what legal protections counsel now affords them.

Under the new bankruptcy law about one half million Americans will be forest to pay for at lest 5 years on longer they will be held in servitude as chattel they will be completely subservient to a dominating influence of the company that holds the loan. Their loan will be put on the market for sale for profit. The people will be forced to work harder. People who fail to go to court will have a arrest warrant made out in their name and people who refuseto pay. They will be subject to fines and or jail. About fifty thousand Americans will punished by a fine and or about three thousand Americans every year will go to jail under the new bankruptcy law. For some people this will be a third strike they will be put in jail for life.

The bill has the support of President Bush, and its passage in the House sometime next month seems likely. If enacted into law, lending companies will recover more money on what otherwise would be written off as bad loans. Those persons of median and higher income seeking relief would be required to file under Chapter 13 status and pay up to $100 per month under court imposed conditions. It is expected the proposed changes would cause a sharp increase in filings before the new law could take effect.

Volunteers and food needed for flooded Manitoba, Canada

Local municipal and provincial volunteers in Manitoba, Canada are exhausted in their efforts to divert the rising waters of the Red River of the North.

It has been hard work with little sleep for the residents who live on the shores of the Red River to shore up their defences with sandbags, build dikes, clear frozen culverts and break ice jams

Volunteers to spell relief for local volunteers and food are desperately needed.

“It’s a week now we’ve been doing this … you’re talking four, five, six public works guys. In my one community we’ve got 25 volunteer firefighters and those guys have been going 24/7, so of course it’s wearing them down.” said Paul Guyader, Manitoba’s emergency measures coordinator.

“We’re dealing with one of the biggest floods the province has ever seen,” said Steve Strang, mayor of St. Clements, Manitoba “We’ve put out hundreds of thousands of bags already. The municipalities are working very well, we’re working with the provincial government, we’ve brought in every possible resource we could to address this issue. The volunteerism within the community has been phenomenal.”

The Portage Diversion has taken some spring waters from the Assiniboine River and diverted the flow to Lake Manitoba.

Roseau River Anishinabe First Nation has been totally evacuated, as well as many homes near the Canada – United States border.

The cold weather is freezing the ice jams into place. Guyader has had 2 Amphibex Excavators operating on the river breaking up ice.

The Red River is right now 16.7 feet (5 metres) above spring ice conditions. The Red River Floodway gates cannot be opened with the current ice jams.

“If we operate now, we can get ice jamming going into the floodway, jamming up against the St. Mary’s bridge, as such, the floodway capacity would be reduced and would cause higher water levels in the city of Winnipeg.” said Steve Topping, Manitoba Water Stewardship spokesman

The floodway was constructed in 1968 following the 1950 flood to divert the overflow spring flooding waters of the Red River. The floodway has been widened the since the 1997 “flood of the century” and the expansion is expected to be completed this spring. As well Manitoba built permanent dikes around communities within the flood plain since the last two major floods..

The Red River waters will crest between the beginning of April to mid April, at which time also the weather should be warming up. Communities are bracing for higher water levels, more ice jams as well as melting snow in the warmer spring temperatures.

Russia cuts off gas supplies to Ukraine

Russia has ended exports of natural gas to neighbouring Ukraine following a failure to reach a compromise over prices. Gazprom, Russia’s natural gas behemoth, began cutting off supplies at 7:00 a.m. UTC Sunday, January 1.

Gazprom claims to have taken this action because Ukraine refuses to pay the market rate for natural gas which is approximately four times higher than the price previously agreed upon by the two. Ukraine has stated that they are not averse to higher prices but believe they ought to be introduced sequentially. Additionally, Russia does not want to honor its contract to supply gas at $50 per 1000 cubic meters until 2008. By comparison, gas produced by OPEC costs $11.4 per 1000 cubic feet (December 28, 2005)[1], equivalent to $402.6 per 1000 cubic meters, an 8-fold rebate.

Gazprom spokesman Sergei Kupriyanov said enough gas was still being piped via Ukraine to maintain deliveries to other countries, and if they were not getting all their gas, it meant Ukraine was tapping into it. Eighty percent of Russian gas exports to Western Europe pass through Ukraine.

“We have information from the ground that shows Ukraine has started illegally siphoning off Russian gas destined for European consumers,” Kupriyanov said.

Ukraine is of the position that since Russia will not live up to the agreement to sell at $50 per 1000 cubic meters until 2008, Ukraine as a transiting country, has the right to offset the illegal cost increase with seizure of Russian assets – namely the gas going through the pipelines in Ukraine.

Sergei Kupriyanov, press secretary to Gazprom’s chief executive, said “Negotiations reach a deadlock when it comes to discussing actual figures … They have called on us to use price parameters that probably existed in the late 1990s in 2006, which is impossible … The price of gas and other energy resources has risen considerably over the past few years.”

The dispute is also tied to the political situation between the two countries. Although a private business, the largest individual shareholder in Gazprom is the Russian government which owns slightly less than 40%. The dispute was further politicized by the personal intervention of Vladimir Putin who offered Ukraine the chance to delay paying market prices for a further three months. Critics of the current Russian government have argued that Gazprom’s action has been an attempt to punish Ukraine for forging closer links with the West following the Orange Revolution. Putin’s advocates, however, have argued that the status quo is akin to a budgetary transfer between the two governments and costs Russia about US$4.5 billion per year. Special European commission has already counted gas independently,and confirmed its loss. But Ukraine disagrees,saing,that it is unjust.German Kanzler Angela Merkel hopes,that the conflict will end soon. And a recent poll conducted by VTSIOM suggests that 80% of Russian citizens support the move by Gazprom. Ukraine has threatened to retaliate by raising the rent that Russia’s navy pays to use the Ukrainian port of Sevastopol as headquarters for its Black Sea fleet, and refusing to repair Russian rockets, which can be repaired only there.

Culture of creativity features at Furnal Equinox 2018

Visual art, fabric art, photography, performance, dance, virtual reality, and music were all the subject of sessions at Furnal Equinox 2018, a conference held from March 16 to 18 at Toronto’s Westin Harbour Castle. Canada’s largest furry convention by attendance, the annual event offers dozens of subculture-specific programs.

The convention’s communications and public relations coordinator for the event, Ronnie, describes furries as “people that enjoy arts and culture centred around animals and animal-themed topics, essentially. Furnal Equinox in particular, we like to celebrate in a very visual and very […] artistic nature, where we have lots of arts and performances and crafts that go on, and people celebrate with lots of socialisation involved.”

Of the attendees, Ronnie told Wikinews “they come from all walks of life. They are people of all ages, sizes, all sorts of backgrounds, and they come together under one mutual interest, which is their love for animal culture.”

“Programming at Furnal Equinox involves[…] a lot of informational panels, so you can find out about topics from art and how to draw, or how to visually incorporate different elements into your artworks. You can also find panels that teach you how to write better, be a better fiction author for example,” explained the event representative.

At one panel Wikinews attended, members of its all-volunteer organising committee spoke of the year-long process of planning the event, and their reasons for committing such a significant amount of their time. Said one panelist, “if you’re happy, we’re happy.”

The largest hub of activity at the convention was a dealer’s room; nicknamed the “Dealer’s Den”, giving it an anthropomorphic twist. Vendors were selling original visual art, wearables like faux fur tails or ears, or things like jewellery or soap with motifs that would interest attendees.

The back area of the room was dedicated to a charity auction, with proceeds benefiting Happily Ever Esther Farm Sanctuary. According to the convention website, the charity is “dedicated to rescuing abused, neglected, and abandoned farmed animals. Their goal is to provide a safe, life-long home for all of their residents, and to educate the public about the true nature of farmed animals through tours, volunteer programs, and community outreach.”

Split into groups, some attendees played “Fursuit Games” in front of an audience, like trying to toss a ball into a garbage can. The activity made harder, of course, by the limited dexterity and vision the most of the costumes entail.

At its head is the Australian Statistician. The current Statistician, Brian Pink, started in his position on March 5, 2007, following the retirement of predecessor Dennis Trewin. Wikinews recently caught up with Brian Pink to talk with him about his first year in the position, as well as his previous tenure as Government Statistician at Statistics New Zealand, and the state of mathematical education in Australia.

Australian government provides $15.8 million for North Adelaide Technical College

Australian Minister for Vocational Education and Training, Gary Hardgrave has announced the government will provide AU$15.8 million to establish an Australian Technical College in North Adelaide. The minister said the government was entering into a partnership with the Archdiocese of Adelaide and consortium of industrial and manufacturing companies.

The North Adelaide college will be located in Elizabeth and be operated as an independent non-government school. The college is one of 25 to be established across the country.

Enrolments at the college will begin in 2007 and will offer courses in areas where identified skills shortages exist in the North Adelaide region, specifically – engineering, construction, electronics and cooking.

Mr Hardgrave said that the proposed college had been popular among the North Adelaide business community. “This important initiative has been well received by North Adelaide business and industry, and will help to address skills needs and provide opportunities for those in greatest need, including a lot of Indigenous students in the region,” Mr Hardgrave said.

“The fact that this College is being led by local employers, local government and other key stakeholders, means it will be truly industry and community driven,” he said.

Australian Technical Colleges were established to cater for year 11 and 12 students who wish to do an apprenticeship as part of their school education.

The Australian Education Union has expressed a number of concerns about the model put forward by the government. In a report, they claim that trade facilities at TAFE colleges (operated by state governments) will deteriorate as funding is diverted to the ATCs. The union is also concerned that ATCs are supposed to be selective VET schools. According to the union they will have selective entry and preferential funding. It is feared that teachers will be lured away from schools and TAFE colleges to higher paid positions in ATCs.

The Education Union suggested that the government invest in schools that already offer vocational education programs.

New Zealand announces new Matariki public holiday

The New Zealand Government on Thursday announced the creation of a new public holiday, Matariki. Matariki marks the beginning of the M?ori New Year, which coincides with the rising of the star cluster Pleiades, known as Matariki in the M?ori language.

At Waitangi, New Zealand Prime Minister Jacinda Ardern said “This will be a day to acknowledge our nation’s unique, shared identity, and the importance of tikanga M?ori. It’s going to be something very special, and something uniquely New Zealand.” Ardern also said the new holiday would break up the over-4 month gap between public holidays in June and October.

The date of the Matariki holiday is not consistent from year to year, as it follows Maramataka, the M?ori lunar calendar, but would likely always fall on a Monday or Friday according to Ardern. A Matariki advisory group has been established, with M?ori Crown Relations — Te Arawhiti — Minister Kelvin Davis explaining that the purpose of the group is “to provide advice on future dates of the public holiday, how it should be celebrated and to support the development of resources to educate the public on Matariki and the celebrations”. The first Matariki holiday is scheduled for Friday, June 24 of next year.

Ardern’s Labour Party made the Matariki holiday an election promise, and won last year’s general election with a majority. This result was the best for any party since New Zealand’s 1996 adoption of a mixed-member proportional system.

This is not the first attempt to make Matariki a public holiday. In 2009, M?ori Party Member of Parliament Rahui Katene introduced legislation to create a Matariki public holiday. While it was supported by the then-opposition Labour Party, the governing National Party did not support it, and it was defeated with 59 votes in favour and 63 votes against.

Gastric bypass surgery performed by remote control

A robotic system at Stanford Medical Center was used to perform a laparoscopic gastric bypass surgery successfully with a theoretically similar rate of complications to that seen in standard operations. However, as there were only 10 people in the experimental group (and another 10 in the control group), this is not a statistically significant sample.

If this surgical procedure is as successful in large-scale studies, it may lead the way for the use of robotic surgery in even more delicate procedures, such as heart surgery. Note that this is not a fully automated system, as a human doctor controls the operation via remote control. Laparoscopic gastric bypass surgery is a treatment for obesity.

There were concerns that doctors, in the future, might only be trained in the remote control procedure. Ronald G. Latimer, M.D., of Santa Barbara, CA, warned “The fact that surgeons may have to open the patient or might actually need to revert to standard laparoscopic techniques demands that this basic training be a requirement before a robot is purchased. Robots do malfunction, so a backup system is imperative. We should not be seduced to buy this instrument to train surgeons if they are not able to do the primary operations themselves.”

There are precedents for just such a problem occurring. A previous “new technology”, the electrocardiogram (ECG), has lead to a lack of basic education on the older technology, the stethoscope. As a result, many heart conditions now go undiagnosed, especially in children and others who rarely undergo an ECG procedure.
