US Supreme Court upholds ban on partial birth abortions

The Supreme Court of the United States on Wednesday April 18 has upheld the federal Partial-Birth Abortion Ban Act of 2003. The 5-4 vote reflected the change in vote count resulting from the retirement of Justice O’Connor and the confirmation of Chief Justice Roberts and Justice Alito.

The Intact dilation and extraction procedure, also known as partial birth abortion, involves removing an intact late-term fetus from the womb via the cervix. While it is a relatively rare operation – 0.17% of all abortions in the US in 2000, it has become a focal point in the abortion debate.

The Partial-Birth Abortion Ban Act bans the procedure in cases where the fetus is terminated during the operation, unless it is performed to to save the life of the mother.

Justice Kennedy wrote in the opinion of the court: “respondents have not demonstrated that the Act would be unconstitutional in a large fraction of relevant cases.” Further, he said, “Respondents have not demonstrated that the Act, as a facial matter, is void for vagueness, or that it imposes an undue burden on a woman’s right to abortion based on its overbreadth or lack of a health exception. For these reasons the judgments of the Courts of Appeals for the Eighth and Ninth Circuits are reversed.”

In a concurring opinion, Justice Thomas stated that he joins “the Court’s opinion because it accurately applies current jurisprudence, including Planned Parenthood of Southeastern Pa. v. Casey, 505 U. S. 833 (1992).”

In dissent Judge Ginsburg wrote: “Today’s decision is alarming. It refuses to take Casey and Stenberg seriously. It tolerates, indeed applauds, federal intervention to ban nationwide a procedure found necessary and proper in certain cases by the American College of Obstetricians and Gynecologists.”

Justice Kennedy’s words also recall the complicated issues of standing related to such cases. An issue in Roe v. Wade was the impossibility of any individual having standing in a court proceeding regarding abortion rights, since court proceedings take more than the 9 months of pregnancy, retiring any individual plaintiff’s standing before an appeals process can take place. The criterion of “a large fraction of relevant cases” may effectively deny standing to any plaintiffs who wish to litigate particular restrictions in some relevant future cases.

Wikinews interviews former Salt Lake City mayor and 2012 presidential candidate Rocky Anderson

Former Salt Lake City mayor and human rights activist Rocky Anderson took some time to discuss his 2012 U.S. presidential campaign and the newly-created Justice Party with Wikinews reporter William S. Saturn.

Anderson served as mayor of Salt Lake City for eight years (2000–2008) as a member of the Democratic Party. During his tenure, he enacted proposals to reduce the city’s carbon emissions, reformed its criminal justice system, and positioned it as a leading sanctuary for refugees. After leaving office, Anderson grew critical of the Democratic Party’s failure to push for impeachment against President George W. Bush, and for not reversing policies on torture, taxes, and defense spending. He left the party earlier this year and announced that he would form a Third party.

Anderson officially established the Justice Party last week during a press conference in Washington D.C.. He proclaimed “We the people are powerful enough to end the perverse government-to-the-highest-bidder system sustained by the two dominant parties…We are here today for the sake of justice — social justice, environmental justice and economic justice.” The party promotes campaign finance reform and is attempting to appeal to the Occupy Wall Street movement. It is currently working on ballot access efforts, and will hold a Founding Convention in February 2012 in Salt Lake City.

Among other issues, Anderson discussed climate change, health care, education, and civil liberties. He detailed his successes as mayor of Salt Lake City, stressed the importance of executive experience, and expressed his views on President Barack Obama and some of the Republican Party presidential candidates. He spoke in depth about former Massachusetts governor Mitt Romney, with whom he worked during the 2002 Winter Olympics, and fellow Utahan, former governor and U.S. ambassador to China Jon Huntsman, Jr..

Also popular are beads featuring pearls. These hard objects are produced within the soft tissue of a living shelled mollusk. A pearl is made up of calcium carbonate in minute crystalline form, which has been deposited in concentric layers. The ideal pearl is perfectly round and smooth, but many other shapes of pearls occur.

The most valuable pearls occur spontaneously in the wild, but they are extremely rare. These wild pearls are referred to as natural pearls. Quartz is an ever-present material in jewellery making, so it is of little surprise that Amethyst is a violet variety of quartz. Amethyst occurs in large geodes within volcanic rocks.

The name comes from the Ancient Greek for the words not intoxicated a reference to the belief that the stone protected its owner from drunkenness; the ancient Greeks and Romans wore amethyst and made drinking vessels of it in the belief that it would prevent intoxication.

The ancient Egyptians used amethyst as a gemstone while medieval European soldiers wore amethyst amulets as protection in battle the reason for this being that amethysts are believed to heal people and keep them cool-headed.

Despite heavy snowing, tens of thousands of workers and supporters marched today in Ljubljana, Slovenia in the largest demonstration since the country’s independence in 1991 to protest against the government programme of economic reforms, including privatisation of public services, tax cuts for businessmen and the abolition of the lower value added tax rate for items like food and books.

The protests, jointly organized by several trade union federations and attended by representatives of almost all Slovenian trade unions, began with an hour-long march from Ljubljana’s Tivoli park to the Congress Square (Kongresni trg). Workers and trade unionists were joined by supporters from Croatia, Italy and Austria, as well as students, anarchist groups, and general population. Several politicians from the opposition Liberal democracy and Social democrats were seen in the crowd. Noisy protesters armed with whistles, rattles and even some flares, marched through the snow waving trade union flags and carrying banners denouncing government policies. There were even a couple of old socialist flags with red stars. Riot police were seen on side streets and guarding accessess to government buildings, but they did not intervene.

The protest continued at the Congress Square with speeches of the representatives of trade unions and student organizations who denounced the government policy as leading into greater inequality and decreased standard of living for ordinary people. The loudest boos of the audience were drawn by the remarks about blaming the unemployed for being unemployed, introduction of university fees, and government’s waiving of taxes and health and pension fund contributions for church officials. The speeches were followed by a musical program, but the crowd soon started dispersing to escape the weather. Trade unions organized transport for 40,000 people to attend, but many buses were stuck in traffic jams on snowy roads and arrived too late for the protest. The police estimated the number of protesters to 25,000.

British government scraps planned rules on pay equality

The British Conservative-Liberal Democratic coalition government has scrapped plans by the previous government to change the rules on equal pay between men and women.

The previous Labour government included a provision in the Equality Act 2010—Section 78—to allow the government the option to introduce regulations that would require companies to publish details of the difference in pay between male and female employees. If the government had activated such regulations, they would have come into force in 2013. The current government have decided not to activate this requirement and instead will only ask businesses to provide this data voluntarily and will set an “aspiration” to dramatically increase the number of women in senior positions in business.

Lynne Featherstone, the Liberal Democrat MP and coalition Equalities Minister, in announcing the plans stated that the government wishes “to move away from the arrogant notion that government knows best, to one where government empowers individuals, businesses and communities to make change happen.”

Featherstone announced the policy at the School of Management at Cranfield University, who have conducted research finding that only 12.5% of directors of FTSE 100 companies are women, up from 12.2% last year—”glacially slow” progress according to business commentator David Prosser.

Featherstone justified not implementing the pay audits due to the economic costs: “Right at this moment of financial peril to the nation is perhaps not the moment to introduce mandatory pay audits.”

This breaks with a Liberal Democrat manifesto commitment, as well as contradicting Featherstone’s own words two years ago in support of the audit: “A voluntary audit system for private industry is hardly worth the paper it’s printed on. We need to know when the government actually plans to step in if progress isn’t made.”

Women’s groups and trade unions have condemned this move. Dave Prentis, the general secretary of UNISON, Britain’s second largest trade union, said that this is an example of the government “stripping down its commitment to equality”.

It is a disgrace that women are still getting paid less than men. This move threatens to turn the clock back on all the progress already made with equal pay.

Ceri Goddard, the chief executive of the feminist campaigning group the Fawcett Society, condemned the plans: “The persistent gap in pay between men and women is one of the starkest examples of inequality in the UK today. The government’s decision not to bring into force section 78 is a huge disappointment and means this injustice will continue for a long time to come. The government has today consigned another generation of women to lower pay. Their proposal to rely only on voluntary business action on pay isn’t just naive, it sends a dangerous signal that tackling discrimination against women is a choice, not a requirement.”

Yvette Cooper, Featherstone’s shadow minister on the Labour benches, called the news “another broken promise from the government” and said that “scrapping Labour’s plan to increase transparency in pay is a backwards step for women’s equality.”

Labour grabs poll lead in UK General Election campaign

The approval ratings of UK Labour leader Ed Miliband rose above those of his Conservative opponent, David Cameron, for the first time in this year’s bitterly fought general election campaign. The poll results showed support for the Labour Party was also rising.

A poll by Panelbase yesterday showed Labour six points ahead; a similar survey by Survation for the Daily Mirror showed Labour four points ahead of the Conservatives. This latter poll was mixed for the Labour leader as it showed only 25% of voters were convinced Miliband was suited to the job of Prime Minister while 37% preferred David Cameron, but it also shows that people preferred Miliband’s recent conduct as party leader to Cameron’s. A poll by TNS found a three point lead for Labour.

ComRes polling indicated the eventual outcome of the election is too close to call, projecting the Conservatives with 34% of the vote and Labour 33%.

Following the poll results, the Conservative Party fired a volley of negative remarks towards Labour. Defense secretary Michael Fallon said Ed Miliband would end up signing up for “a grubby backstairs deal” with the Scottish National Party (SNP) which would lead to the cancellation or non-renewal of the Trident nuclear submarine programme. The Labour Party have stated they support the continuation of Trident and will not negotiate on Trident with the SNP.

Fallon’s comments on Trident were backed up by David Cameron.

The Labour Party counter-claimed a deal between the Conservatives and Liberal Democrats had put the cost of Trident renewal up by £1.4bn.

Miliband responded to Fallon’s comments: “Michael Fallon is a decent man, but today I think he has demeaned himself and he has demeaned his office. National security is too important to play politics with and I will never compromise national security.”

Former Labour leader Tony Blair said Fallon’s remarks hinted at desperation: “The Tories were up to their old tricks in their personal attack on Ed this morning. I remember the ‘demon eyes’ poster of 1997. It is always a sign of desperation and it will backfire. It shows how nervous they are of a Labour campaign full of confidence, which is showing that it understands the challenges facing working people and how to overcome them. The more they indulge in these tactics the better we should feel.”

Liberal Democrat Vince Cable expressed his displeasure at Fallon’s remarks, saying it was “an appalling way to conduct the argument”.

The two main parties have also proposed a number of new ideas for policy. Labour’s Yvette Cooper is to formally announce a new policy today to protect 10,000 police officers’ jobs by eliminating elected Police and Crime Commissioners and gun licensing subsidy, and sharing of police back-office services and procurement. The Labour crime and justice manifesto also includes creating a new commission on sexual and domestic violence, banning “legal highs”, and reforming prisons to introduce more education and work for prisoners.

Conservative Cameron pre-announced a proposal to change the rules so workers in the public sector and for companies with 250 employees or more — which between the two is estimated to be around half the work force — would be entitled to three days of paid volunteering leave per year. In prepared remarks, Cameron is to call the move represents the “clearest demonstration of the Big Society in action”. This marks a return of the language of the ‘Big Society’ which had slowly disappeared from use since the last election.
