One of the world’s most advanced earthquake warning systems in Japan has been found to have some practical use problems. The Japan Meteorological Agency (JMA) apologized on Tuesday for erroneously issuing an “earthquake early warning for advanced users”, with regards to an earthquake which occurred on the Monday night at sea off Ibaraki Prefecture, eastern Japan. There was, in fact, no possibility of huge tremors. The root cause was a simple human mistake that happened while setting a single seismograph with a criterion. The accidental release of the warning also revealed that some receiver devices could not handle warnings properly under certain conditions.
JMA operates a system called “Earthquake Early Warning” (EEW). It is designed to analyze seismic waves as soon as possible after an earthquake is detected, and issue a warning if large tremors are expected to happen. Its purpose is to minimize the damage caused by seismic tremors. Two EEW schemes were put into practical use in 2006 and 2007.
The warning was released by the EEW scheme for advanced users such as railway operators, workers in factories, managers at some offices and schools, and some local cable TV broadcasters. Another EEW scheme for the general public, which is utilized by nationwide broadcasting networks such as NHK, was not involved in this incident.
All four subway lines operated by the Tokyo Metropolitan Bureau were suspended in response to the first false warning, even though it was corrected within 11 seconds. At a private railway company, an EEW receiving system crashed, apparently because of the wrong data. East Japan Railway Company, which has its own earthquake observation network, judged the warning to be an error and didn’t take a real reaction in its railway operation.
In addition to troubling railway companies, the warning also caused confusion among people. Some commercially-sold receiver devices failed to handle the warning appropriately. Some of them, adapted by an information distributor company for its service, displayed an incredible magnitude of 12.7, while the warning didn’t include a datum of the JMA magnitude. One device at a junior high school boarding house in Aichi Prefecture called an alert as if the seismic intensity could have reached to the Scale 6 Lower (the third highest of 10 JMA scales), causing some girl students to cry. The device didn’t say that the students were far away from the focus.
Such failures show that recipients of an “EEW for advanced users” are not always trained well enough to react appropriately. Ironically, in the JMA building a similar case was also confirmed. A receiver device displayed a Scale 7 alert, the highest of JMA scales.
According to JMA’s announcement on the same night and news conference on the following morning, one seismograph was incorrectly set with the criterion of acceleration at 10 gals. (Correctly the criterion is at 100 gals.) This mistake resulted in the first (false) warning, which was soon corrected by the second warning. The JMA confessed that the seismograph has not undergone a check since it was installed in December, 2003.
The EEW scheme for advanced users is designed to put priority on calling alerts, so it releases a warning even if data from only one observation point is known. The same simple human mistakes were not committed at other points, according to JMA. In the parallel EEW scheme for the general public, the same mistake would not cause the same error, because it releases a warning based on data from multiple observation points, not depending on the criterion of acceleration.

General Motors Corporation (GM), an American automaker which has filed for bankruptcy protection, announced on Friday that the Penske Automotive Group (PAG) was selected to purchase Saturn Corporation. The transaction should be completed in October.
The purchase includes rights to the Saturn brand, its five current models and its dealership network. Two models would be discontinued, the Sky and Astra. GM would continue building the Aura sedan, the SUV’s, Vue and Outlook for at least two more years.
Saturn has 350 dealers across the United States. The dealers employ more than 13,000 jobs and sell only the Saturn autos. Canadian Saturn dealers are not included in the deal.
According to Penske future Saturn vehicles will be fuel economy focused. An expert indicated that this would move Saturn back to its roots of a entry level car company. PAG is in talks with several international automakers to replace GM after 2011. Automotive News reports that Renault Samsung Motors of Korea is the most likely candidate.
Penske wants Jill Lajdziak, Saturn’s general manager, and Tom LaSorda, former Chrysler President to head up the company when it is independent of GM.
Serra Automotive in Grand Blanc Township, Genesee County, Michigan, is in talks to take a partial ownership in a new Saturn lead by Penske.

“We’re dealing with one of the biggest floods the province has ever seen,” said Steve Strang, mayor of St. Clements, Manitoba “We’ve put out hundreds of thousands of bags already. The municipalities are working very well, we’re working with the provincial government, we’ve brought in every possible resource we could to address this issue. The volunteerism within the community has been phenomenal.”
The Portage Diversion has taken some spring waters from the Assiniboine River and diverted the flow to Lake Manitoba.
Roseau River Anishinabe First Nation has been totally evacuated, as well as many homes near the Canada – United States border.

Buffalo, New York —In a statement, attorney Arthur Giacalone in charege of the case, Nancy Pollina et al opposing Savarino’s Elmwood Village Hotel, who is co-owner with Patty Morris of Don Apparel at 1109 Elmwood in Buffalo, New York has said that the preliminary hearing in New York State Supreme Court has been delayed.

Although the properties are “under contract,” it is still not known whether Savarino Construction actually owns the buildings. It is believed that Hans Mobius, a resident of Clarence, New York and former Buffalo mayoral candidate, is still the owner. The hotel is expected to be a franchise of the Wyndham Hotels group.
Buffalo’s Common Council, Planning Board, Mayor of Buffalo, Byron W. Brown, Savarino Construction Services Corporation, Hans J. Mobius and his son Hans S. Mobius owners of the properties at stake, Pano Georgiadis, owner of Pano’s Restaurant on Elmwood, and Cendant Corporation, the parent company of Wyndham Hotels are among those named in the suit.
According to Giacalone, the city of Buffalo has requested two week extension to prepare their defense. Area councelman Joseph Golombek has been contacted to further confirm the date change request, but has not yet responded.

Kent Hovind‘s Appeal for his and his wife, Jo’s, felony convictions was recently denied by Eleventh Circuit Court. The court found that the Hovinds’ appeal was “without merit.” Kent and Jo were convicted of 58 and 44 tax-related felonies respectively, obstruction and intimidation of federal officers, willful failure to collect and pay taxes, and structuring to avoid bank reporting requirements. Kent is a Pensacola young Earth creationist/Evangelist and operator of Dinosaur Adventure Land whose speaking engagements and merchandise earned US$5 million from 1999 to March 2004.
The Appeal looked at several issues and concluded that there was enough evidence to convict the Hovinds and that the government did not err. Among other issues, it ruled “Sufficient evidence establishes that Kent failed to collect or pay withholding taxes.” It cited that “Employees of Evangelism Enterprises, peers, and legal counsel testified that Kent disputed the authority of the Internal Revenue Service based on the separation of the church and state, debated the interpretation and application of the withholding requirements, and intentionally characterized Evangelism Enterprises as a ‘church’ and his employees as ‘missionaries’ to avoid tax obligations.”
The Appeals court also ruled that the Hovinds “challenge the validity of their convictions on the ground that the statute does not penalize transactions below $10,000,” but the court ruled “this interpretation does not comport with the language of the statute.” Furthermore, it found “that Kent intended to impede agents of the Revenue Service (IRS) in their efforts to investigate and prosecute Kent’s violations of the tax laws” by “fil[ing] complaints and sued agents of the Internal Revenue Service and instituted legal proceedings to circumvent the lawful seizure of his assets.” Lastly, it affirmed the forfeiture of substitute property when the original property was transferred or deposited with a third party.
On January 19, 2007 Kent was sentenced to ten years in prison and ordered to pay US$640,000 in owed funds to the IRS, pay prosecution’s court costs of $7,078, and serve three years parole once released. Whereas, in June 2007 Jo was sentenced to one year and one day in prison, but the judge released her pending appeal.
